§1 Use of the Bosch Smart Camera App
Please note that in order to use certain functionalities of the Bosch Smart Camera App, your mobile device has to have an existing data connection or such a connection has to be established by using these functionalities. We therefore recommend using the Bosch Smart Home App only if you have a flat rate for mobile data or have access to a wireless LAN hotspot in order to avoid incurring connection charges.
These are usually the most recent versions of iOS or Android. If the system requirements change in the course of time, for instance because the security mechanisms of the older versions are no longer sufficient and can therefore no longer be supported, you will be informed by Bosch under the following link: https://www.bosch-smarthome.com/uk/en/ooa/system-requirements/
The App is a constant subject to further development which means that new functions and services in addition to the free basic version are being offered at regular intervals. Additional functions and services within the App can be or become subject to payment of a fee. In this case Bosch will advise you of the prices and service features in advance. The cost-free control of components in your home network (Wi-Fi) will remain and will be useable in any case.
Please note that additional functions of the App might only run smoothly if the corresponding Bosch Smart Home devices are up to date. Older generation Bosch Smart Home devices might not be compatible with all the functions of the App. The technical requirements can be found in the descriptions of the App.
You are not permitted to copy or distribute the App or to otherwise make it available to third parties (including by letting, leasing, loaning or sub-licensing it). You do not have the right to change, reverse engineer, decompile or disassemble the program code of the App or parts thereof or to establish the source code in any other way or to produce derivative works from it. OSS components where the license requires that the end customers is allowed to reverse engineer them for their own or for debugging purposes, are excluded from this restriction. The provisions of sections 69d and 69e German Copyright Act (UrhG) however remain unaffected by this.
Bosch reserves all rights to the App.
§2 Obligations to collaborate
When using the App, you must comply with the duty of care required for use, and before using the results generated by the software you have to examine the results to a reasonable degree. You are obliged to store safely all the access data, such as your user name and your password.
The requirement for the use of the App is that a Bosch 360° indoor camera and/or a Bosch Eyes outdoor camera is installed in the United Kingdom or the Scottish Highlands and Islands or the Isle of Wight or the Isle of Man and that all components are connected to the Bosch video backend (“Bosch Video Cloud”). You are responsible for correct installation and for the connection to your home network yourself.
Additional technical requirements for the use of the App are set out in the description of the Application in the App Store, in particular the operating systems / versions and mobile devices such as Smartphones and Tablet PCs that are supported.
The app will show you upcoming updates for the camera software and will ask for your consent prior to installation, as well as new improved functionalities and updates for error correction, through which you will not be placed in a worse position objectively compared to the services agreed to at the time of the conclusion of the contract and which do not diverge drastically from those. The consent to updates of the App is administered by your mobile device’s operating system; the rules and settings of your operating system apply.
You have to adapt these accordingly if applicable and obtain information from your provider. Bosch cannot influence this. If you do not consent to update the software or do not consent to the app in general, it is possible, if there is no other technical possibility that hereby the operation of the app or the devices will be impaired or the use is no longer possible. In such a case you have the right to terminate the further usage relationship of the App. This regulation applies accordingly insofar as changes to the App and/or to the device software become necessary due to amended stipulations by third parties which Bosch procures upstream services from, or due to substantial technical innovations on the market.
If, as an entrepreneur within the meaning of section 14 German Civil Code (BGB), you paid for acquisition of the App, the obligation to object to defects as set out in section 377 German Commercial Code (HGB) applies.
§3 Warranty and liability
a. Warranty and liability for software that is free of charge. Bosch is liable for defects as to quality and defects of title, regardless of the legal ground, only insofar as Bosch fraudulently failed to disclose the respective defect as to quality or defect of title. In all other respects, Bosch, its statutory representatives and agents engaged in performance of an obligation (Erfüllungsgehilfen) is/are liable on the basis of the provision of the software free of charge to compensate for damage which may have been incurred, only in the event of misconduct caused by intent or gross negligence or in the event of damage caused culpably by injury to life or limb or impairment to health. Claims under the German Product Liability Act (Produkthaftungsgesetz) shall remain unaffected.
b. Limitation of liability for software subject to payment of a fee. Insofar as you have paid a fee for acquisition of the software, Bosch is only liable, regardless of the legal ground, in accordance with the following provisions:

Insofar as the liability is not governed by the statutory regulations according to the above enumeration, the following applies: In cases of a violation of only non-material contractual obligations by slight negligence (leicht fahrlässige Verletzung), Bosch is not liable for damages. Furthermore the liability for damages caused by slight negligence is limited to damages that typically have to be faced in such contractual relationships (foreseeable damage typical of the contract). Damages caused by the use of the App on devices with full administrative access are considered to be non-foreseeable.
This also applies to breaches of duty caused by a neglect of duty by the statutory representatives, executive employees or simple agents employed in performance of an obligation (Erfüllungsgehilfen).If you are an entrepreneur as defined in section 14 BGB, the parties agree that the maximum amount of the foreseeable damage typical for the contract ensuing from breaches of duty under this Agreement corresponds to the value of the remuneration paid to Bosch under this Agreement. The aforesaid restrictions of liability also apply to claims for compensation for expenditure.
(1) Insofar as the liability of Bosch is excluded or limited under these provisions, this also applies to the liability of the executive bodies (Organe), agents employed in performance of an obligation (Erfüllungsgehilfen) and vicarious agents (Verrichtungsgehilfen), including the employees of Bosch.
(2) The warranty period for defects as to quality and defects of title is 12 months for software which you acquired as an entrepreneur for remuneration. This does not apply if the liability is based on the statutory regulations pursuant to sub-section b. above.
The App, together with an installed Bosch camera, can inform you of events occurring in your house or apartment by sending text messages to your mobile device. Bosch can only transmit these text messages if the following is guaranteed:
Please note that the Bosch Smart Video system, comprising the App, cameras and backend, are only intended for use in the home environment and that it is by no means suitable for use in especially critical areas. The system does not constitute an alarm system or an intruder detection alarm in accordance with the corresponding DIN, EN or VdS standards, especially not in accordance with the DIN standard EN 50131.
The availability of the system can be interrupted for necessary maintenance and service work.
Bosch uses Push Notifications to send the messages to your mobile device. For this the messages are encrypted prior to transmission to your mobile device. Further information on the messages and the data included can be found in our Data Protection Notice.

When you establish contact, your customer data is used for a specific purpose.
In the event of a support case, you are asked to provide your identification data. You can grant Bosch, more particularly the employees of the customer hotline, access to the system status (e.g. personal data, configuration data, historical data, system data). If this is required in connection with support cases, the personnel on the customer hotline will ask you to confirm the access permission by means of a number code shown in the App.
In order to process possible inquiries and to comply with the legal documentation obligations, Bosch will store the customer history for 10 years after the last interaction with customer support. Personal data relating to a specific problem case is erased automatically no later than 3 years after the problem was solved. Annexes are handled in compliance with the statutory retention periods and stored accordingly and/or also automatically erased within 3 years after the problem has been resolved.
Bosch only provides support for the current version of the software.
Further information on the handling of personal data is provided in §8.
Insofar as you permit a third party to use your device that the software is installed on, on a temporary basis free of charge, then you remain responsible for compliance with the provisions of this Agreement. Any other transfer of the rights of use requires our explicit consent. In addition, transferability can be excluded by means of technical blocks set by the provider through which the software is distributed.
Through the use of the software by third parties, the settings relating to data protection and privacy can also be affected and lead to deviating behavior. You shall be held responsible for the compliance and enforcement of the desired settings by the third parties.
If you should permit a third party to use a video camera on a permanent basis, then please use the function “Factory Setting” in the App’s Settings beforehand. Thereby you delete all user and system data from the smart home system.
With the help of the App function “Delete Account” you are further able to delete all the user and system data linked to this account in the App, all the cameras connected and the backend.
§7 Third-party services / use via partner Apps
The services of third-party providers that are integrated into the Bosch Smart Camera App expand the possibilities of the Bosch Smart Camera App. The use of these integrated or external services generally requires your user account to be connected to your user account with your existing third-party provider.
The provision of the third-party provider integration within the Bosch Smart Camera App and/or the coupling to external services constitutes an additional functionality; Bosch does not guarantee its availability and Bosch may, in principle, discontinue provision thereof at any time without prior notice. As a rule, Bosch is unable to verify that the data transmitted by the third-party provider is correct and complete, and does not assume any liability in this respect.
In addition, Bosch can, in principle, also enable the use of the Bosch Smart Camera via Apps of partner companies. In order to use the Bosch Smart Camera via a partner company or via the App of a partner company, it is necessary for the data and status information of the Bosch Smart Camera to be stored in the Bosch Smart Home cloud so that the partner company can access the stored data in the cloud and can use this to control the Bosch Smart Camera. Bosch also has the right not to activate specific functionalities in the partner Apps – for example for security reasons.
Your explicit consents in the respective Apps are required for storage of data in the cloud and for the access and the control by the partner companies.
Without explicit consent there is no storage in the cloud and it is not possible either for the partner company to have access or for you to have access via the partner company’s App.
The special terms and conditions of use of the partner company apply to the use of the partner App. You can find these in the partner company’s App and these terms have to be accepted separately.
Solely the partner company and not Bosch is responsible for the partner App, the App’s availability as well as the respective terms and conditions of use. Bosch does not guarantee neither the provision nor the availability of Bosch Smart Home devices via the partner App and does not assume any liability in this respect.
Bosch may, at any time without prior notice, restrict or discontinue the provision of partner Apps and may suspend access.
§8 Data protection, consent
a. General comments on data protection
Robert Bosch Smart Home GmbH performs its services from Germany. Accordingly, the provisions of data protection law applying at the undertaking’s head office apply.
b. Reference to your responsibility under data protection law
The Bosch Smart Home indoor camera has been developed for areas indoors. You bear the responsibility for the lawful implementation of the camera and services and for compliance with the statutory provisions applying at the implementation location. Laws in your country can, in particular, stipulate permissible designated purposes, installation locations, the choice of image details and the period of storage for video sequences. If necessary, you must inform the persons, employees or third parties living in or frequenting the premises and areas under surveillance in a suitable manner with regard to the specific circumstances and the implementation of the visual security solution and obtain necessary permissions.
c. Consent to data processing
Insofar as we wish to process or use your personal data for purposes other than that of performing the contract and if there is no legal permission, Robert Bosch Smart Home GmbH makes this conditional upon your prior consent. You can grant your consent actively in good time, that is to say before the respective collection, processing and use of personal data.
Once granted, you may withdraw your consent at any time free of charge vis-à-vis Robert Bosch Smart Home GmbH, Schockenriedstr. 17, 70565 Stuttgart, with future effect. d. Third-party services / use via partner Apps
You have the possibility of also using the Bosch Smart Camera via Apps of partner companies. Your consent is required for this. In order to use the Bosch Smart Camera via a partner company or via the App of a partner company, the data and status information of the Bosch Smart Camera have to be stored in the Bosch Smart Home cloud so that the partner company can access the data stored in the cloud and control the Bosch Smart Camera by using it.
The partner company is responsible for the partner App and for the associated data processing under data protection law. Bosch cannot influence this. Please note the terms and conditions of use and the data protection notices of the partner company with respect to its handling of your personal data.
Bosch will notify the customer of all changes. In the change notification, the customer will be advised of his right of objection or his right of and also of the consequences of an objection. If the customer has a right to object and does not object within 30 calendar days after receipt of the change notification, the changes will be deemed effectively agreed as from the date of expiry of the time limit.
In the event of an objection, Bosch reserves the right to terminate the usage relationship and to discontinue the eligibility for use of the App. The statutory warranty rights shall remain unaffected.
§11 Information on dispute resolution before consumer arbitration boards:
Bosch does not participate in dispute resolution proceedings before consumer arbitration boards.
§12 Applicable law, jurisdiction
The substantive law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods, is applicable. If you are not a consumer or have no general place of jurisdiction established in Germany, the courts of Stuttgart, Germany, shall have jurisdiction and venue over all disputes arising through or in connection with this Agreement.
This choice of law does not mean that the user is deprived of the protection granted to the user by those provisions from which, according to the law of the country in which the user has habitual residence, no derogations may be made by agreement (favorability principle).

The protection of your privacy throughout the course of processing personal data as well as the security of all business data is an important concern to us. 3. Collection, processing and usage of personal data
The Bosch Smart Camera App, the video cameras connected to it and the online storage accessible via the app, serve with their functionalities to make your home safer. For the execution of the contract, i.e. for the provision of related services (e.g. functionalities of the app, storage of image data in the online storage), it is necessary that we collect data that can be related to you or another natural person.
Personal data is all information that refers to an identified or identifiable natural person, such as names, addresses, telephone numbers, e-mail addresses, contract, booking and billing data that are an expression of a person's identity. Some of the data we process is not personal data. With regard to this information, we have neither an interest in identifying a natural person, nor do we have the necessary knowledge or the legally permissible means to establish a personal reference. For example we may use such non-personal data to improve our products.
We only collect, process and use personal data if we have a legal basis for this or if you have given us your consent in this regard, e.g. as part of a registration. Several legal bases can be applicable in parallel and allow the processing of personal data.

Registration via the central Bosch-ID
You may register for our online offers exclusively using the central Bosch-ID. The centralised Bosch-ID was devised by Bosch.IO GmbH for the Bosch Group in order to allow for the joint users to benefit from offers of different group companies using centralised application data and increase data safety.
Bosch.IO GmbH, Ullsteinstraße 128 12109 Berlin, Germany is responsible for the provision of this single sign-on service.
After successful registration you may utilise the registration data used for the centralised Bosch ID also for registering for this online offer. To this end, we shall provide an Robert Bosch GmbH registration template for the centralised Bosch-ID. The Bosch.IO GmbH then shall confirm your authorisation and provide us with the master data required for using our offers (e.g. surname, first name, date of birth, company name, email address, telephone numbers, mail address). Your password shall not be communicated to us.
Concerning further data transfers within the Bosch Group associated with the centralised Bosch-ID, please refer to the Data Protection Notice.
3.2 Processing purposes and legal bases
We; as well as the service providers commissioned by us; process your personal data for the following processing purposes:

3.3 Log files
Each time you use the internet, your browser is transmitting certain information which we store in so-called log files.
We save log files to determine service disruptions and for security reasons (e.g., to investigate attack attempts).
3.4 Data transfer
Data transfer to other controllers
Principally, your personal data is forwarded to other controllers only if required for the fulfillment of a contractual obligation or the implementation of pre-contractual measures, or if we ourselves, or a third party, have a legitimate interest in the data transfer, or if you have given your consent. Particulars on the legal bases can be found in the Section - Purposes of Processing and Legal Bases. Third parties may also be other companies of the Bosch group. When data is transferred to third parties based on a justified interest, this is explained in this data protection notice.
Additionally, data may be transferred to other controllers when we are obliged to do so due to statutory regulations or enforceable administrative or judicial orders.
Use of service providers
We involve external service providers with tasks such as sales and marketing services, contract management, payment handling, programming, data hosting and hotline services. We have chosen those service providers carefully and ensure that they carefully handle the data that they store. All service providers are obliged to maintain confidentiality and to comply to the statutory provisions. Service providers may also be other Bosch group companies. When involving external service providers, we might transfer personal data to recipients located outside the EEA into so-called third countries.
3.5 Integration of components provided by other providers
3.5.1 Connection to systems, apps and services of other providers ("Smart Home Cloud")
With Bosch Smart Home you have control over your data. If you wish, you can share your device data with partner companies (hereinafter referred to as partners) and control your Bosch Smart Home products via their systems, apps or services.
This requires that you grant access to your Bosch Smart Home cameras and the generated data to the respective partner. This data may be personal.
If you want to allow the partner to access and control the cameras, activate the function "Mirror system in cloud" in the Bosch app. The data generated by your system or products will then be mirrored in the Bosch Smart Home Cloud. You can then allow specific partners to access and control your cameras. This is done in the following way: You open the partner's app and agree to link and control your smart home cameras and transfer data. If you control your smart home camera through partner apps, we may need to transmit data that may be personally identifiable (e.g., room or device names).
If you have given your consent, the option to access and control will remain active until you deactivate it. If you wish to terminate a partner's access, you can revoke the data authorization via "Change Authorizations" on the Bosch Smart Home Cloud website (authz.smarthome.bosch.com/Applications). If you generally no longer want to mirror your data in the Bosch Smart Home Cloud, you can deactivate it in the Bosch Smart Home App. This will delete your mirrored data. If you want to share your cameras with a partner again, you can reactivate the "Bosch Smart Home Cloud" function in the Bosch Smart Camera App.
If you want to withdraw the authorisation from a certain partner, proceed as follows: You revoke the authorisation of the partner via this app and thus break the link of the partner account to the Bosch ID, so that the partner is no longer allowed to control your Bosch products and services.
Additionally, you should withdraw the authorisation from the partner on the Bosch Smart Home Cloud Website (“App Settings” > “Partners” > “Manage Authorisations”). Not only does this ensure that the account link is removed but also that the authorisation is revoked.
If you remove the data of the cameras from the cloud in the Bosch Smart Home Camera App, your mirrored data will be deleted. However, the authorisations you have granted to partners will remain so that you can continue to use them in the future. If you do not wish to do so, you can withdraw the authorisation from the partner separately beforehand.
3.5.2 Use of Amazon Alexa
You have the option of controlling your Smart Home products via Amazon Alexa voice commands. To do so, you have to connect your Smart Home products to Amazon Alexa. If you control your Smart Home product via Alexa, you may have to transmit personal data via Amazon to your Smart Home product and vice-versa.
If you give voice commands to Amazon Alexa in order to control Smart Home products or retrieve information from your Smart Home product, voice data are transmitted to Amazon and used by Amazon to perform the service. These data may be personal data. By connecting your Amazon Alexa and Bosch accounts and by activating skills, you make it plain that the Smart Home product installed on your system is to be controlled via Amazon Alexa and that information is to be output via Amazon Alexa and you instruct us to exchange data with Amazon Alexa in this context. You and Amazon are responsible for the data processing that is entailed. The data processing performed by Amazon is subject to Amazon's usage and privacy protection terms. Bosch has no influence on them. Please refer to Amazon's usage and privacy protection terms with regard to Alexa for more information on data processing by Amazon.
3.6 Duration of storage; retention periods
Principally, we store your data for as long as it is necessary to render our Online Offers and connected services or for as long as we have a justified interest in storing the data. In all other cases we delete your personal data with the exception of data we are obliged to store for the fulfillment of legal obligations (e.g. due to retention periods under the tax and commercial codes we are obliged to have documents such as contracts and invoices available for a certain period of time).
In certain cases, we will offer you the option to arrange for the deletion of data yourself. For instance, if you use the delete function in the Bosch Smart Camera app, the images recorded in the data storage facilities in the video camera, Bosch Smart Camera App and online data storage will be deleted. Personal data and configuration information will also be deleted and will no longer exist.
Our employees and the companies providing services on our behalf, are obliged to confidentiality and to compliance with the applicable data protection laws.
We take all necessary technical and organizational measures to ensure an appropriate level of security and to protect your data that are administrated by us especially from the risks of unintended or unlawful destruction, manipulation, loss, change or unauthorized disclosure or unauthorized access.
5. User rights
To enforce your rights, please use the details provided in the Contact section. In doing so, please ensure that an unambiguous identification of your person is possible.
5.1 Right to information and access:
You have the right to obtain confirmation from us about whether or not your personal data is being processed, and, if this is the case, access to your personal data.
5.2 Right to correction and deletion:
You have the right to obtain the rectification of inaccurate personal data concerning yourself without undue delay from us. Taking into account the purposes of the processing, you have the right to have incomplete personal data completed, including by means of providing a supplementary statement.
This does not apply to data which is necessary for billing or accounting purposes or which is subject to a statutory retention period. If access to such data is not required, however, its processing is restricted (see the following).
5.3 Restriction of processing:
You have the right to demand for – as far as statutory requirements are fulfilled – restriction of the processing of your data.
5.4 Objection to data processing:
You have the right to object to data processing by us at any time. We will no longer process the personal data unless we demonstrate compliance with legal requirements to provide provable reasons for the further processing which are beyond your interests, rights and freedoms or for the establishment, exercise or defense of legal claims.
5.5 Objection to data processing based on the legal basis of „justified interest “:
In addition, you have the right to object to the processing of your personal data any time, insofar as this is based on the legal basis of justified interest. We will then terminate the processing of your data, unless we demonstrate compelling legitimate grounds according to legal requirements for the processing, which override your rights.
5.6 Withdrawal of consent:
In case you consented to the processing of your data, you have the right to object this consent with immediate effect. The legality of data processing prior to your revocation remains unchanged. In addition, processing may continue to be permitted on the basis of another legal bases.
5.7 Data portability:
You are entitled to receive data that you have provided to us in a structured, commonly used and machine-readable format or – if technically feasible – to demand that we transfer those data to a third party.
This does not apply if a transfer affects the rights and freedoms of another person.
5.8 Right of complaint with supervisory authority:
You have the right to lodge a complaint with a supervisory authority. You can appeal to the supervisory authority which is responsible for your place of residence or your state or to the supervisory authority responsible for us. This is:

6. User responsibility
You are responsible for ensuring use of the Bosch Smart Camera solution in compliance with the law. In this context, you are obliged to comply with the statutory provisions which are applicable to you or the place of use, particularly those relating to data protection.
Applicable statutory provisions may, in particular, restrict the purposes of use, installation locations, selection of image details and storage period of the video sequences. If required, inform persons, employees or third parties who live in the monitored premises or who are present there for a significant period of time of the use and specific circumstances of the Bosch Smart Camera solution as is appropriate.
